  1. This Privacy Policy sets out the rules for the processing of personal data obtained through online shop: www.VANNSKJOLD.com (hereinafter referred to as the "Shop")
  2. The data controller is OXXO Sp. z o.o., registered office in Warsaw, ul. Strąkowa 15 A, 01-100 Warsaw, entered in the Commercial Register of the National Court Register, the District Court for Warsaw, in Warsaw, XII Commercial Division, under number KRS: 0000948824, statistical number REGON: 521082240, tax number NIP: 5272987075, which provides services electronically as well as stores and accesses information in the Customer's devices via the VANNSKJOLD.com website.
  3. Personal data collected by OXXO Sp. z o.o. through the Shop will be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), referred to as “GDPR”.
  4. The Company collects information on natural persons performing a legal transaction not directly related to their activity, natural persons conducting a business or professional activity on their own behalf, and natural persons representing legal persons or non-corporate organisational units (which have legal capacity by virtue of law) conducting a business or professional activity on their own behalf, hereinafter collectively “Customers”.
  5. Registration in the VANNSKJOLD.com Shop requires the User's consent to the processing of his or her Personal Data to the extent and for the purpose necessary to use the services provided by VANNSKJOLD.com as part of the Shop, including the transfer of Personal Data to third parties with which VANNSKJOLD.com provides services as part of the Shop and the transfer of such data is necessary for the proper performance of the service. The consent is given by clicking the checkbox available on the Shop website.

Subject to the cases indicated in the Terms of Service, the Personal Data is processed on the basis of Article 6(1)(a) of GDPR, and Article 6(1)(b) of the Regulation in order to provide services in the Shop, including: the handling and processing of orders placed in the Shop, the handling of complaints and the handling of the User's activities in the Shop (e.g. posting opinions).

The categories of Personal Data that will be processed by VANNSKJOLD.com are: (a) username, (b) email address, (c) telephone number, (d) first name (e) surname (f) postal address (g) geographical location (h) technical data about the devices used to access the Account (i) internet and/or network connection data (including IP address), (j) mobile device identifier, (k) type of operating system, (l) type of browser or other software, hardware or other technical details provided by the browser, (m) metrics on when and how the Account is used, current status, (n) purchase history and links selected, (o) preferences and choices for example subscriptions, (p) preferred language and currency, (q) posts published on forums or other services offered through the Account, (r) payment information including name and email address, payment method, payment platform, type of transaction.

In connection with the provision of services, Personal Data will be disclosed to external entities, including, in particular, suppliers responsible for operating IT systems used for order processing, entities such as banks and payment operators, entities providing accounting, legal, tax services, couriers (in connection with order processing), marketing agencies (within the scope of marketing services) and entities related to VANNSKJOLD.com, VANNSKJOLD.com reserves the right to disclose information concerning the User to the competent authorities or third parties who request such information within the limits of the applicable law, as well as for the purpose of establishing, investigating or defending against claims.
  10. If you make a purchase in the Shop, your personal data may be passed on, depending on your choice, to the following entities for the purpose of delivering the ordered goods: 
    1. couriers, postal operators,
    2. payment processors,
    3. banks.  
  11. Navigation data may be used to provide better service to customers, to analyse statistical data and to adapt the Shop to customers' preferences, as well as to administer the Shop.
  12. If the Customer subscribes to a newsletter, the Company will send e-mails containing commercial information about promotions and new products available in the Shop to the Customer's e-mail address.
  13. If a request is made, the Company will make personal data available to authorised authorities, in particular to the Public Prosecutor's Office, the Police, the President of the Personal Data Protection Office, the President of the Competition and Consumer Protection Office or the President of the Electronic Communications Office in Poland.
  14. By using the Shop, the User consents to the saving of cookies or other analogous technology (more information on cookies: https://allaboutcookies.org). The consent is expressed by clicking the cookies notice at the bottom of the page.
  15. You have the right to access your Personal Data and the right to rectify, erase, request restriction of its processing, the right to data portability, the right to object to its processing, the right to withdraw your consent to processing at any time, which will not affect the lawfulness of the processing already carried out based on the consent before its withdrawal.
  16. In order to withdraw the consent to the processing of Personal Data or to exercise other rights referred to above, please send a message to iod@VANNSKJOLD.com with a relevant request. As a consequence of the withdrawn processing consent, the services of the Shop and to order processing will be impossible.
  17. The User has the right to lodge a complaint with the President of the Personal Data Protection Authority in Poland ("PUODO") when the processing of Personal Data concerning the User violates the provisions of GDPR.
  18. Providing the Personal Data is voluntary, however it’s a prerequisite to use the services provided by VANNSKJOLD.com in the Shop. Consequently, refusal to allow VANNSKJOLD.com to process the User's Personal Data will prevent the use of the services which VANNSKJOLD.com provides in the Shop as well as the processing of purchase orders.
  19. The User's Personal Data is processed for the duration of the Account and will be immediately deleted in the event of its deletion. The period of data processing may be extended in the event that the processing is necessary for the establishment, investigation or defence against possible claims in judicial, administrative or other non-court proceedings, as well as at the request of competent public authorities, and after this period, only in the case and to the extent required by law. After the expiry of the processing period, the data will be irreversibly deleted.

The VANNSKJOLD.com Shop is entitled to send commercial information to the User's e-mail address, in accordance with the provisions of the Polish Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2013, item 1422, as amended). The commercial information may be sent only after the User has given his/her prior consent in the manner indicated on the Shop's website. The consent is given by clicking the checkbox available on the Shop's website.
  21. If you provided e-mail address for this purpose, VANNSKJOLD.com provides the newsletter service. The sending of information via the newsletter is possible upon a given person giving his/her prior consent in the manner which will be notified on the Shop's website. The consent is given by clicking on the checkbox available on the Shop website.

The provision of data is voluntary but required in order to provide the newsletter service, and failure to do so or to request deletion of the data will prevent distribution of the newsletter. The following Personal Data is processed as part of the newsletter service:

  2. Customer’s personal data may be processed in an automated manner (profiling), however, this will not have any legal effect on them or similarly significantly affect customers.
  3. The Company's profiling of personal data consists of the processing of Customer’s data in an automated and manual manner, by using it to assess certain information about the Customer, in particular to analyse or forecast the Customer's personal preferences and interests.
  4. In order to reach the Customer with marketing messages via the Shop, the Shop uses its own cookie mechanisms to retrieve information about the Customer's activity on the Shop website. We have the legitimate interest (according to Article 6(1)(f) of GDPR) to tailor marketing messages to preferences and interests.
